Can You Fly with CBD?

Although laws are constantly changing, it’s best not to assume anything but rather know what the rules are so that you can avoid any unpleasant surprises the next time you go through security at an airport.
The TSA’s Rules for FLying with CBD
If you are flying with CBD products in your possession, you need to know the rules. As of May 2019, if your CBD fits the TSA carry-on guidelines and meets federal regulations, you are allowed to have it in your carry on or checked baggage. However, it must be less than 3.4 fluid ounces if you have it in your carry-on luggage, and the CBD product must contain less than 0.3% THC on a dry weight basis. This should be clearly visible on the packaging.
Tips for Traveling with CBD
To keep things running smoothly, be ready to show TSA officials the label on your CBD product(s). Check your CBD products before you pack them to ensure they are indeed hemp-derived. Cannabis derived CBD products are still federally banned and will be confiscated, as these types of CBD products typically have much more THC than hemp-derived options. It is important that you know the laws as well as your rights regarding possession of CBD products.
According to the official Transportation Safety Administration (TSA) website: “Marijuana and certain cannabis infused products, including some Cannabidiol (CBD) oil, remain illegal under federal law except for products that contain no more than 0.3 percent THC on a dry weight basis or that are approved by FDA. (See the Agriculture Improvement Act of 2018, Pub. L. 115-334.) TSA officers are required to report any suspected violations of law to local, state or federal authorities. TSA’s screening procedures are focused on security and are designed to detect potential threats to aviation and passengers.
Accordingly, TSA security officers do not search for marijuana or other illegal drugs, but if any illegal substance is discovered during security screening, TSA will refer the matter to a law enforcement officer.” The website also notes that “The final decision rests with the TSA officer on whether an item is allowed through the checkpoint.” This notation alone is enough to make one stop and consider whether it’s worth the risk to try and bring that CBD oil, lotion, cream, gummy, or other product on the plane. If all it takes to pull you out of the line and into a private area to speak with a law enforcement officer is a TSA official in a bad mood, you may want to leave your CBD products at home the next time you fly.
